Draft for review

This is a working draft. It will be reviewed by a qualified professional before the site launches and before any personal or health information is collected.

Who we are

Fagan Performance is run by John Fagan, who decides how your information is used (the "controller" under UK and EU data protection law). Questions about your information can be sent through the contact page.

What we collect

Coaching applications: your name, email address, country, time zone, preferred contact method (and a phone or WhatsApp number only if you choose one), and what you tell us about your training, racing, goals and expectations, plus your confirmation that you understand the subscription price.

Contact form: your name, email address, the topic and your message.

We deliberately don't ask for medical diagnoses, injury histories or medical records in these forms. Please don't include them. Health information is only ever collected through a separate clinical service, after you've given informed consent.

To protect the forms from spam we use Cloudflare Turnstile, and we briefly keep a one-way scrambled version of your IP address to limit repeated submissions. It is deleted automatically, normally within a day, and your IP address itself is never stored.

How we use it

To review your application, reply to you, arrange consultations and, if you become a client, provide your coaching. We don't sell your information or use it for advertising.

For people in the UK and EU, the legal basis is taking steps at your request before entering into a contract (applications) and our legitimate interest in replying to enquiries.

Who helps us

Google Firebase (database, United States), Vercel (website hosting), Cloudflare (spam protection), Resend (email delivery) and Cal.com (booking). Each processes information only to provide its service to us. Because these services are based in or use the United States, information from the UK and EU is transferred there under the providers' standard data protection terms.

How long we keep it

Applications that don't lead to coaching, and enquiries, are deleted within 12 months. If you become a client, your information is kept for as long as you're coached and for a limited period afterwards, which will be set out in the client terms. You can ask us to delete your application at any time.

Your rights

Depending on where you live, you can ask to see, correct or delete your information, or object to how it's used. In the UK you can complain to the Information Commissioner's Office, and in Ireland to the Data Protection Commission. US residents may have rights under their state's privacy laws.

Online physiotherapy (not yet open)

Health information for the Online Physiotherapy service will be collected and stored separately from coaching data, in a system designed for clinical records, only after you've given informed consent. The rules that apply depend on where you are, for example HIPAA in the United States and GDPR in Ireland and the UK.
